Terms of use

1. What mzassist is

mzassist answers questions about mzmine by searching the public mzmine documentation and the public mzmine source code, and composing an answer with citations back to the pages and source lines it used. It is an aid to finding your way around that material.

mzassist is provided at no charge and is not sold, either separately or as part of an mzmine licence. It is not part of your mzmine licence agreement: these terms govern it, and they are the agreement between you and us for its use.

2. Accepting these terms

You accept these terms yourself, before you first use mzassist. They are an agreement between you and mzio GmbH about your own use of the service. They do not commit your employer or any other organisation to anything, and they change nothing in any mzmine licence agreement.

If you do not accept them, you cannot use mzassist. Nothing else follows from declining: your mzmine licence and your mzmine account are unaffected.

We record that you accepted, which version, and when. If we change these terms we will ask you again.

3. Access, allowance, and scope of use

mzassist requires a current mzmine COMMUNITY or PRO licence and a signed-in mzmine account. There is no anonymous access. Access lasts only as long as that licence does and ends with it; there is no separate term and no notice period, and we may end access to mzassist at any time without affecting your mzmine licence.

You may use mzassist within the same scope as the mzmine licence through which you have access. Under a COMMUNITY or academic licence, commercial use of mzassist is prohibited, exactly as it is for mzmine itself. Under a commercial licence, commercial use is permitted. No charge is made for mzassist under any licence, and the absence of a charge neither permits nor restricts any use in itself.

How many questions you may ask per day depends on your mzmine account tier. The current allowance is always shown in the app, and the figure shown there is the one that applies. We may adjust allowances as the service and its running costs develop.

Where your access comes through an organisation's mzmine licence, that organisation can have your access to mzassist withdrawn at any time.

4. Acceptable use

When using mzassist, you agree not to:

5. Monitoring and enforcement

We record usage of the service — who asked, when, how much it cost, and the text of the question — for the periods set out in the privacy notice. We do this to control cost, to keep the service available, and to detect and investigate misuse.

Where we have reason to believe the service is being misused, we may retain the relevant records beyond their normal deletion date for as long as it takes to deal with the matter, restrict or withdraw access without notice, and where we are legally required to do so, or where there is a serious risk to someone, report the matter to the competent authorities.

6. The AI service behind mzassist

For the provision of mzassist we make use of artificial intelligence technologies (hereinafter also referred to as the “Integrated Services”), operated by a third-party provider named in the privacy notice. We use the Integrated Services for the automated generation of the answers mzassist produces. With regard to your use of mzassist, the following shall apply:

We expressly recommend that you thoroughly review all responses and outputs generated by mzassist before using them for their intended purpose.

The Integrated Services may process content protected by intellectual property rights, including copyright, and the responses and outputs generated by the Integrated Services may themselves contain or constitute copyrighted or otherwise protected works. In this respect, the following shall apply: you grant us the right, free of any third-party rights, claims, or encumbrances, to transfer to the provider of the Integrated Services any copyrighted or otherwise protected content that you process through mzassist. Section 9 governs the rights you receive in content generated by the Integrated Services.

We do not permit the Integrated Services to use what you type to train their models. If we change the provider we use, we will update the privacy notice before the change takes effect.

7. No warranty

mzassist generates answers automatically. They may be incomplete, out of date, or wrong, even when they cite a source. Always check the cited documentation or source code before relying on an answer. The service is provided "as is", with no warranty that it will be available, accurate, or fit for any particular purpose.

Not for regulated use. mzassist is not a validated system. It must not be used as the basis of a regulatory, clinical, diagnostic, or other GxP-relevant decision, and no output from it constitutes a controlled record.

8. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, and where liability is mandatory by law. Otherwise, and in particular for a service provided at no charge, our liability is limited to damage that was foreseeable and typical for this kind of service.

Where you use mzassist under a separate paid agreement with us, the liability provisions of that agreement apply and take precedence over this section.

9. Intellectual property

mzmine and its documentation are covered by their own licences, which apply unchanged to any material mzassist quotes or links to. These terms grant you no rights in the mzmine software, its documentation, or our trade marks.

With regard to any copyrighted works or other protected content generated by the Integrated Services, we grant you a non-exclusive right to use such content in accordance with these terms and within the scope of your use of mzassist. That grant reaches only as far as our own rights do: where an answer contains material belonging to someone else, their rights are unaffected and may limit what you can do with it.

10. Changes and governing law

We may change these terms as the service changes; the current version is always the one on this page. These terms are governed by the laws of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods, and the place of jurisdiction is the competent court at our registered office in Bremen, where legally permissible.
